Deed between Jacob Lewellen and Rachel Barnett

This indenture made this fourteenth day of August in the year of our Lord One thousand eight hundred and one between Rachel Barnett widow of Robert Barnett deceased and Joseph Barnett son and heir of the said Robert Barnett by Samuel Work his Guardian all of the County of Ohio and Commonwealth of Kentucky of the one part and Jacob Lewellen of the same county and commonwealth aforesaid of the other part whereas the said Jacob Lewellen purchased of the aforesaid Robert Barnett in his life time a certain parcel and part of a tract of land and paid the said Robert the full consideration therefore and the said Robert having departed this life before and with out conveying to the said Jacob the aforesaid parcel of land according to the true intent of the contract between him and the said Robert and Jacob the said Jacob sometime after the death of the said Robert exhibited his bill in chancery in the quarter session Courts of Ohio County against the aforesaid Robert and Joseph to compel a conveyance of the said land as by the said bill will more fully appear and there upon obtained a device against the aforesaid Rachel and Joseph for that part . ___ this indenture witnesseth that the said Rachel Barnett and Joseph Barnett by Samuel Work his Guardian for and in consideration of the ____ and in obedience to the before mentioned decree and by and in virtue thereof hath assigned transferred and released and made over unite the said Jacob the said parcel of land and by these presents doth assign transfer and make over release unto ___ and confirm unto the said Jacob Lewellen his heirs forever the aforesaid part of a tract or parcel of land lying and being ___ in the county of Ohio upon the waters of Rough Creek that being a part of Walker Daniels survey of and thousand four hundred and ninety five acres Beginning for the same at John Peake and Massey Thomas line to another corner of the said Thomas land and also a corner of the said Jacob's land thence with the of Robert Barnetts land so the corner of the said Robert's land standing in the field of the said Jacobs Thence to Benjamin Fawlers line and another corner of the said Jacob's land Thomas with said Fawlers line to the North corner of the said Fawlers land and thence by a straight line to the Beginning containing as supposed to certain fifty acres of land be the same more or less. Together with the improvements and appurtenances thereunto belonging or on any wise appertaining with the rents uses and profits thereof and every part and parcel thereof to have and to hold the aforesaid tract or parcel of land and premises with the appurtenances unto him the said Jacob Lewellen and his heirs and assigns and to and for no other use intent or purpose whatever. This deed from Rachel Barnett and Joseph Barnett by Samuel Work his guardian was proved before me Aquilla Field Clerk of the Quartersissions Court of Ohio County on the seventh day of September 1801 by the oaths of Stephen Cleaver and Isaac Powers two of the subscribing witnesses thereto and on the fifth day of October 1801 the same deed was proved by the oath of John Peak one of the subscribing witnesses thereto and ordered to record.
